NY NCSY SWEEPSTAKES 2014 RULES AND REGULATIONS

PRIZE CLAIM INFORMATION:

The drawing will be held on or about Saturday Night, February 1, 2014.  Potential Prize winner(s) will be notified by e-mail and/or telephone within one (1) week after the drawing. The winner must respond to a prize notification within one (1) month (30 days) after his or her selection as winner.  Any potential winner may be asked to provide proof of identity.  Return of any prize notification as undeliverable may result in disqualification and selection of an alternate winner. If a potential winner fails to respond to a prize notification within one (1) month (30 days) after his or her selection, or in the event of non-compliance with any of these requirements, the Prize will be forfeited and a subsequent drawing will be conducted to select the winner.  All properly claimed prizes will be awarded. Prizes must be used or redeemed within one (1) year of claim or the Prize may be forfeited.

If the winner is younger than the age of majority in the state in which he or she resides as of January 1, 2014, then such individual’s parent or legal guardian must provide written permission allowing the individual to accept the Prize and if travel is included in the prize, parent or legal guardian must agree to accompany the winner if the winner has not reached the age of majority in the state in which he or she resides as of the date on which travel arrangements and/or hotel accommodations are made pursuant to the Prize.

By accepting a prize, winner(s) (and his or her parent or legal guardian, where applicable) consent to NCSY’s or any affiliates’ use of winner’s name, photograph and/or likeness, home state, voice, and statements made by or attributed to him or her for legitimate purposes including advertising and promotional activities without additional compensation to the extent permitted by law.

DISCLAIMERS:

Pictures depicting the prizes are for illustration purposes only, and may not be the actual representation of the prize. Some prizes are subject to restrictions. All travel prizes do not include transportation to and from the airport, unless specifically stated, and no provisions for kosher food will be made in that destination unless meals are specifically stated as a component of the prize. All warrantees/guarantees of the prizes are the sole responsibility of the manufacturer. No part of this website may be reproduced without the permission of NY NCSY. ELIGIBILITY: To enter NY NCSY Sweepstakes 2014 (the “Raffle”), you must be 18 or over by the time of entry. By participating in this raffle, you agree to be bound by these Official Rules.

HOW TO ENTER:  To enter the raffle, go to ncsy.org/sweepstakes and click on the “Order” tab/link to access the online entry form for the raffle.  Follow the directions on how to pick packages and purchase tickets, and fill out the non-optional data requested on the online entry form, including indicating your assent to these Official Rules.  All entries must be accompanied by payment to be considered valid.

DATES OF RAFFLE: The Sweepstakes will run from December 1st, 2013 until January 30th, 2014. All entries received after that date will be considered a donation to NCSY.

IDENTITY OF REGISTRANT: All entries will be deemed made by the person whose name was given in the registration process. However, in case of a dispute as to the identity of an entrant using the Internet, the authorized account holder of the email address used to enter the Sweepstakes at the time of entry will be considered the entrant.  The “authorized account holder” is defined as the natural person who is assigned to the email address by an Internet access provider, online service provider, or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address.

DISQUALIFICATION: Should NCSY determine, in its sole discretion, that any entrant has violated these Official Rules; NCSY shall have no obligation to award a Prize to such entrant. Entries generated by robots or scripts or other automated devices are considered to be a direct violation of the Official Rules and the policies of this raffle and will result in the immediate and automatic disqualification from this Raffle of any and all associated entries.

CAUTION: ANY ATTEMPT BY YOU OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE NCSY WEB SERVICE IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, NCSY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

ODDS OF WINNING: The actual odds of winning depend on the number of entries received. This raffle is a joint campaign with an undisclosed number of participating organizations. All entries, regardless of which organization the entrant has donated to, will be entered into one pool for raffle winner selection.

RANDOM DRAWING:  One (1) winner per prize will be awarded, unless otherwise specified. A winner will be selected in a random drawing from among all eligible entries.

PRIZE INFORMATION AND VALUE: Please see below for a list of all of the prizes, which do and do not have a cash value. For those prizes that do not have a cash value and the winner must accept a physical prize, prices are subject to change. If NCSY/Orthodox Union finds better (cheaper) prices without sacrificing on quality of the prizes, they are entitled to purchase the alternative. Below, you will find information on each of the offered prizes in the raffle, as well as specific values, cash values, and fine print not listed in the brochure.

Split the Pot: 1 ticket for $15; 3 tickets for $40; 5 tickets for $60. The winner of this prize will receive half (50%) of the cash collected for this prize. Tickets for this prize are sold separately from the tickets offered in the packages for the raffle. Tickets for this prize may not be combined with any deals or offers made for packages for the raffle.

L’Shma: 1 donation of $10. There is no winner for this option. This category offers donors the opportunity to donate to NCSY without winning a prize. There is no physical prize or cash value associated with this option.

Grand Prize: $25,000 will be awarded to the winner of this prize. Taxes and fees according to the winner’s state/city of residence will be applied. NCSY reserves the right to present winner with $25,000 check, cash, or money gift card. NCSY determines the form of payment the winner of this prize will receive.

$1,500 Visa Gift Card: $1,500 Value. NCSY will award winner with Visa Gift Card may be used wherever accepted. NCSY is not responsible for any taxes, fees, insurance costs associated with the value of the prize.

 

$1,000 Gas Card: $1,000 Value. NCSY will award winner with gift card of the above stated sum. Gift card may be used wherever accepted. NCSY is not responsible for any taxes, fees, insurance costs associated with the value of the prize.

 

$500 Sports Seats: $500 Value. NCSY will award winner with gift card of the above stated sum. Gift card may be used wherever accepted. NCSY is not responsible for any taxes, fees, insurance costs associated with the value of the prize. Winner is responsible for purchasing sports seats of his/her choice.

 

$250 Lottery Tickets: $250 Value. NCSY will award winner with gift card of the above stated sum. Gift card may be used wherever accepted. NCSY is not responsible for any taxes, fees, insurance costs associated with the value of the prize. Winner is responsible for purchasing lottery tickets of his/her choice.

 

$250 Gift Cards: Each of the five (5) gift cards has a $250 Value. Gift Cards are to the following locations or online stores: Lord & Taylor, Toys R’ Us, Amazon, Costco, Artscroll.com. $250 gift cards may be used wherever accepted. NCSY is not responsible for any taxes, fees, or insurance costs associated with the value of the prize. One (1) winner per card. Cannot be redeemed for cash value.

 

Upgrade Your Wheels: $6,000 Value. NCSY will award winner with cash, check, or gift card representing the above stated sum. NCSY is not responsible for any additional fees, taxes, or insurance costs associated with the two-year lease of a Chrysler Town & Country.

 

Kosherica Cruise: Cruise offered for two people (2 tickets). Cruise dates are valid between June 2014 and January 2015. Passover cruises are not included. Winner must book cruise 4 months in advance of the sailing date. Tickets are subject to availability. Airfare to port is not included. Each ticket is valued at $2,200, which brings the total value of the two (2) tickets to $4,400. Tickets are not for any specific destination, but are only valued at the above stated price. NCSY is not responsible for any additional costs associated with the prize. Reservations are for an inside cabin, but can be upgraded. Restrictions apply. Gratuities, port charges, and taxes are not included. Winner may change/upgrade reservations to any cruise destination offered by Kosherica at winner’s expense. PRIZES: One (1) winner will be selected to receive each prize. Since the NY NCSY Sweepstakes 2014 is a joint campaign, other participating organizations will have entrants in each prize’s drawing. LIMITATION OF LIABILITY:  NCSY is not responsible for any incorrect or inaccurate information, whether caused by web site users or by any of the equipment or programming associated with or utilized in the NCSY services or by any technical or human error which may occur in the processing of submissions in this fundraiser, including but not limited to any misprints or typographical errors.  NCSY is not responsible for any problems with your entry, including technical failures related to computer, telephone, cable, and unavailable network or server connections, or other failures related to hardware, software or virus, or incomplete, late or misdirected entries.

NCSY assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries.  NCSY is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the Internet or at any web site or combination thereof, including injury or damage to participants or to any other person’s computer related to or resulting from participating or downloading materials in this Raffle.  If, for any reason, the Raffle is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of NCSY that corrupt or affect the administration, security, fairness, integrity or proper conduct of this Raffle, NCSY reserves the right at its sole discretion to cancel, terminate, modify or suspend the raffle.

NCSY expressly disclaims any liability arising from the use of registration information by third parties. 
In no event shall NCSY, its parents, affiliates, subsidiaries, and related companies, its advertising and promotional agencies, or its officers, directors, employees, attorneys, agents and representatives be liable whatsoever for any injuries, losses or damages of any kind arising from or in connection with, either directly or indirectly, (1) the awarding, acceptance, receipt, possession, use and/or misuse of any prize awarded herein; and/or (2) participation in the Raffle or any prize related activities, including but not limited to traveling to or from any prize related activity.  Upon delivering the Prize to winner, NCSY will be deemed to have awarded the Prize with winner (or his or her parent or guardian) assuming full responsibility for the Prize.

Under no circumstances will raffle entrants be permitted to obtain awards for, and you hereby waive all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees. You further waive all rights to have damages multiplied or increased.

Without limiting any representations or warranties, NCSY has the right (though not the obligation) to, in NCSY’s sole discretion, reject or remove from NCSY’s websites, servers and computer systems any entry that, in NCSY’s sole discretion, violates these Official Rules or is in any way harmful or objectionable.  NCSY also reserves the right to disqualify any entry at NCSY’s sole discretion.

ENTIRE AGREEMENT:  These Official Rules, and any guides or rules referred to herein, constitute the entire agreement, and supersede any prior or other agreements, between you and NCSY in relation to the raffle.  To the extent of any inconsistency between these Official Rules and any other representations concerning the raffle, these Official Rules prevail.

PRIVACY:  All information submitted online is subject to NCSY’s Privacy Policy.  By participating in the raffle, you hereby agree to NCSY’s collection and use of your personal information pursuant to this policy.  Winner grants NCSY the right to use and publish his or her proper name and home state in connection with this raffle.

SEVERABILITY: By participating in the raffle, you agree that if any provision of these Official Rules is found to be invalid or unenforceable by a court of competent jurisdiction the remaining provisions shall remain in full force and effect to the extent consistent with the intentions of the parties.
